No-Fault Divorce
Also commonly referred to as an “uncontested” divorce, a no-fault divorce essentially means that both parties have agreed to not blame the other for the divorce. This also means that spouses do not have to prove any sort of misconduct, only that they must show they’ve been separated for a year or more.
At-Fault Divorce
South Carolina provides four grounds for at-fault divorce:
- Adultery
- Physical cruelty/abuse
- Willful desertion of a year or more
- Habitual drunkenness/drug abuse.
It’s important to remember that just because one party alleges fault against another does not make it so. The party leveling blame must prove the misconduct in court.
